Acceptance of Terms

Welcome to Foundation for Collective Prosperity, Inc. ("FCP," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our website at collectiveprosperity.org and all associated services, features, content, and applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

Account Registration

Some features of our Services may require you to register for an account. When you register, you agree to:

Maintain and promptly update your account information
Maintain the security of your password and accept responsibility for all activities under your account
Notify us immediately of any unauthorized access to your account

Intellectual Property

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by FCP, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial use. This license does not include:

Any resale or commercial use of our Services or their contents
Any collection or use of any content, product listings, or descriptions
Any derivative use of our Services or their contents
Any downloading or copying of account information for the benefit of another party
Any use of data mining, robots, or similar data gathering tools

Trademarks

The FCP name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Foundation for Collective Prosperity. You may not use such marks without our prior written permission.

User Content

Our Services may allow you to submit, upload, publish, or otherwise transmit content, including text, images, and other materials ("User Content"). You retain ownership of your User Content, but by submitting it, you grant FCP a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with our mission and Services.

Content Standards

User Content must comply with the following standards:

Must not contain any material that is defamatory, obscene, indecent, abusive, offensive, or hateful
Must not promote violence or discrimination based on race, sex, religion, nationality, disability, or age
Must not infringe any patent, trademark, trade secret, copyright, or other intellectual property rights
Must not violate the legal rights of others or contain material that could give rise to legal liability
Must not be likely to deceive any person
Must not promote any illegal activity

Donations and Contributions

Foundation for Collective Prosperity, Inc. is a 501(c)(3) tax-exempt organization. Donations made to FCP may be tax-deductible to the extent allowed by law.

Donation Processing

All donations are processed securely through our third-party payment processor
FCP does not store credit card or bank account information on our servers
Donations are final and non-refundable except in cases of processing errors
Tax receipts will be issued for all eligible donations

Recurring Donations

If you set up a recurring donation, you authorize FCP to charge your designated payment method on a recurring basis. You may cancel recurring donations at any time by contacting us or through your account settings.

Donor Privacy

We respect donor privacy and will not sell, share, or trade donor names or personal information with any other entity, nor send mailings to our donors on behalf of other organizations, unless explicitly authorized.

Grant Applications

FCP accepts grant applications from organizations and individuals aligned with our mission. By submitting a grant application, you agree to the following:

All information provided in the application is accurate, complete, and truthful
FCP may conduct due diligence, including background checks and reference verification
Submission of an application does not guarantee funding
All grant decisions are at the sole discretion of FCP and are final
If awarded a grant, you agree to comply with all terms and conditions of the grant agreement

Reporting Requirements

Grant recipients are required to submit progress reports and financial documentation as specified in grant agreements. Failure to comply with reporting requirements may result in termination of funding and requirement to return unused funds.

Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make them available. The following activities are expressly prohibited:

Systematic retrieval of data or content to create a collection, compilation, database, or directory
Making any unauthorized use of the Services, including collecting usernames and/or email addresses
Circumventing, disabling, or otherwise interfering with security-related features
Engaging in unauthorized framing of or linking to the Services
Tricking, defrauding, or misleading us and other users
Attempting to impersonate another user or person or using the username of another user
Uploading or transmitting viruses, Trojan horses, or other malicious code
Interfering with or disrupting the Services or networks connected to the Services
Using any automated system to access the Services without our written permission

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER FCP NOR ANY PERSON ASSOCIATED WITH FCP MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.

WITHOUT LIMITING THE FOREGOING, NEITHER FCP NOR ANYONE ASSOCIATED WITH FCP REPRESENTS OR WARRANTS THAT THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

FCP HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

Limitation of Liability

IN NO EVENT WILL FCP, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

Indemnification

You agree to defend, indemnify, and hold harmless FCP, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Content, any use of the Services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.

Third-Party Links

The Services may contain links to third-party websites or services that are not owned or controlled by FCP. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that FCP shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Modifications to Terms

We reserve the right to revise and update these Terms at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Services thereafter.

Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page periodically so you are aware of any changes, as they are binding on you.

Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Dispute Resolution

Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of New York, in each case located in New York County. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Waiver and Severability

No waiver by FCP of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of FCP to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
